Process Service Fees For Secretary of State / Out of State / Out of Country
 Service Fee  Notes
Out of State (other than New York, New Jersey, Connecticut) $175 minimum Many factors impact on the cost to serve process out of state, including the difficulty of completing the task.  We may contract with an associated private investigator or experienced process server depending on the factors involved.  By convention in some states, a fee is imposed for each service, even if effected by one delivery
Service via NYS
Secretary of State (see notes below)
$110 Fee is per corporation or other business entity for which the NYS Secretary of State may accept process.  Most documents are sent by email in pdf format to our Albany office for printing and service.  If you need your copies service, please note we will send them by overnight delivery to our Albany office.  The statutory fee paid to the Secretary of State is $40.  We charge a small fee for making this disbursement.
Outside the United States  $500 minimum As with out of state service, many factors impact on the cost and the ability to effect civil process in any particular country.  Documents may need to be translated into the native language.  Special care must be taken to assure that it is legal in that country to serve process in a matter pending before a court or tribunal of a non-native country.  The person(s) providing the service must be authorized to perform that service in that country.  And care must be taken to assure that affidavits of service, in proper form, fully and completely notarized, possibly with an Apostille, are prepared and returned on a timely basis.Service via the Hague Convention may also be effected.  For any matter pending in a US District Court, service via the Hague Convention is required.  However, concurrent service by a private process server is often performed in order to avoid long delays in effecting service of process by a foreign country’s central authority.  Contact us for more complete information.
Canada We have an extensive network of process servers in Canada.  Documents pertaining to courts or tribunals other than US federal courts or tribunals are handled in a manner very similar to service in the United States, at about the same rates.  Contact us for more complete information.
When serving the New York State Secretary of State Service of process for any corporation or other business entity via delivery to the NYS Secretary of State is effective only on the date that the Secretary of State ACCEPTS the documents after it has determined that the documents meet certain criteria:

  • The court / tribunal must be situate within the State of New York.
  • For service upon a domestic, authorized or alien corporation or business entity ON FILE with the Secretary of State, pleadings must reflect character of the corporation or business entity EXACTLY as found with the Secretary of State  (ie: domestic corporation or  authorized foreign corporation – including the name of its domestic jurisdiction).
  • The name of the corporation or business entity must be stated EXACTLY as on file (ie: “corporation” or “corp”. – including any punctuation marks in the name).
